FAQs About Digital Waiver E-Signatures

If you’re reading this, you want to know if the e-signatures on WaiverForever’s documents are legally binding and if user data is secure. We get these questions a lot, so we put together this FAQ to showcase our variety of e-doc compliance and security features. All of our waivers are fully compliant with the Electronic Signatures in Global and National Commerce (ESIGN) Act.
Here are the answers to some common questions to provide you with peace of mind that the electronic waivers your customers signed are fully enforceable and safe.
What is the difference between an electronic signature and a digital signature?
WaiverForever supports both electronic signatures and digital signatures. These are not the same concepts, even if they sound like it.
An electronic signature, as set out in the “electronic sound, symbol, or process attached to, or associated with, a contract or other record and adopted by a person with the intent to sign a record.” In the context of our waivers, this is when someone signs the waiver with their finger on a tablet. This signature is then imprinted on the saved waiver.
Digital signatures provide an added layer of security, and along with drawing a signature, allow for someone to type in their name as an acceptable form of consent in an e-doc.
WaiverForever uses a public key infrastructure (PKI) to associate a signer with their waiver signature. When a user signs a WaiverForever document, their signature links a “fingerprint” of the document to your identity and it is permanently embedded into the document, and the document will show if someone comes in and tries to tamper with it after you’ve signed it.
While both forms of signatures are legally binding, we highly recommend you use a digital signature, as it is more likely to be defendable in court.

Please also note that whenever a waiver is signed, the customer will also receive a copy via e-mail. These records are also maintained.
Is WaiverForever secure when set up as a waiver kiosk?
Setting up the WaiverForever app as a kiosk is a great way to streamline your business. One setting that is often overlooked is the ability to “lock” the app while in kiosk signing mode. This will effectively prevent your customers from navigating outside of the app and accessing data they shouldn’t.
If you would like to lock the “Kiosk” while signing the waivers, remember to use the kiosk mode passcode feature.
What if I want to unpair a device from WaiverForever?
We’re happy to provide up to 60 devices to a single account depending on your plan. If you end up wanting to unpair an Android or Apple device, remember to always successfully clear your previous device to avoid access to customer information.
We’re also happy to note that you don’t need a device for WaiverForever to work. Customers can sign from their own devices by visiting your waiver online, or scanning a bar code if they wait in-person. This feature also provides a sense of e-signature security and is a great method for your business. Your customers can trust signing a waiver from their own personal device; meaning you can extend a level of trust the same way you trust WaiverForever to be your waiver signing service!
Additional security measures for e-signatures
While we can ensure that our e-signature technology is safe and secure, there are external factors you should consider for your business in order to keep user data safe. Here are a few security considerations:
Am I using public Wi-Fi?
Public wi-fi is a known danger to anyone’s personal information. If you use a public wi-fi connection to your business devices, ask yourself how you can secure a wifi password, the router or your devices further, such as with a VPN.
Password protect devices
While we want to trust an unlocked iPad or Android tablet will not be tampered with, when there is sensitive client data involved, one cannot take a chance. Adding a passcode, a fingerprint ID or additional passwords to devices used across the business ensures a layer of protection and voids vulnerability.
Security software
With WaiverForever’s constant app updates for any vulnerabilities and a trusted server to protect our customers, this means your own devices should see a constant update to the latest iOS, firmware or security update, in order to stay in line with WaiverForever’s own updates and support changes.
